This page outlines the Terms of Service for all photography services, sessions, and membership programs offered by Elicia Wilson Photography (“Photographer”).
By booking a session, purchasing a membership, or selecting “I agree to Terms and Conditions,” you acknowledge that you have read, understood, and agreed to these terms.
Membership Programs
Memberships are designed for families and clients who want consistent, ongoing photography throughout the year.
Depending on your membership, benefits may include:
Annual family sessions
Birthday Club mini sessions (for eligible families)
Priority booking access
Member-only events and limited sessions
Exclusive pricing and discounts
Private client gallery access
Membership benefits are non-transferable, non-refundable, and have no cash value.
Billing & Payments
Memberships are billed monthly through automatic subscription via Stripe.
All payments are non-refundable
You authorize recurring monthly charges
It is your responsibility to maintain a valid payment method
Accounts more than 30 days past due may be suspended or canceled
If a payment fails, access to membership benefits may be paused until the account is brought current.
Active Membership Requirement
Membership benefits are only available while your account is active and in good standing.
If your membership is paused, canceled, or becomes delinquent:
All unused benefits are forfeited
Benefits cannot be reinstated or credited
No refunds will be issued
Annual Session Eligibility
If your membership includes an annual family session, eligibility requires:
Six (6) consecutive successful monthly payments
Active membership status at time of booking and session date
If membership is inactive at any point before your session is completed, the session benefit is forfeited.
Cancellation Policy
After any required initial commitment period, you may cancel your membership with at least 14 days written notice before your next billing date.
No refunds for prior payments
No credits for unused benefits
Benefits not used prior to cancellation are forfeited
Early cancellation does not relieve financial responsibility for any remaining contractual term (if applicable).
Rescheduling Policy
Each session includes up to two (2) client-initiated reschedules.
Additional reschedules may result in forfeiture of the session
No-shows or cancellations within 24 hours count as a reschedule
Photographer-initiated reschedules (weather, illness, emergencies) do not count against you
All reschedules are subject to availability.
Travel Fees
Travel within 30 miles of the following locations is included:
2248 County Road 1675, Jacksonville, MO 65250
189 VFW Road, Eldon, MO 65026
Travel outside this radius is billed at $1.00 per mile (round trip) and invoiced separately prior to your session.
Weather Policy
Sessions may be rescheduled due to unsafe or unsuitable weather conditions, including but not limited to rain, storms, extreme temperatures, or hazardous travel conditions.
All weather decisions are made solely by the Photographer. Weather reschedules do not count against your reschedule limit and do not qualify for refunds.
Model Release
Unless otherwise agreed in writing, you grant Elicia Wilson Photography permission to use images from your session for:
Portfolio display
Website and marketing
Social media
Advertising and promotional materials
Client Conduct & Safety
The Photographer reserves the right to end any session immediately if unsafe, disrespectful, or inappropriate behavior occurs.
No refunds will be issued if a session is terminated due to client conduct.
Artistic Control
You understand and agree that photography is an artistic service.
The Photographer retains full creative control
Editing style and artistic decisions are final
Dissatisfaction with style is not grounds for refund
Delivery & Gallery Access
Galleries are delivered within up to 12 weeks
Online galleries are available for 6 months unless otherwise stated
Download and backup your images during this time
Copyright & Image Use
All images remain the intellectual property of Elicia Wilson Photography.
You are granted a personal-use license, which allows:
Personal printing
Social media sharing
Personal gifts and keepsakes
Commercial use, editing, or resale is not permitted without written consent.
Liability
Elicia Wilson Photography is not liable for injuries, damages, or losses occurring during sessions.
Total liability is limited to the amount paid for services.
Agreement
By booking a session, signing a contract, or selecting “I agree to Terms and Conditions,” you confirm:
You have read and understand these Terms
You agree to all policies outlined above
You are at least 18 years of age and authorized to enter this agreement
